The lawsuit was filed by Saad S., a man from New Jersey who was implanted with the Meridian® Inferior Vena Cava Filter (“IVC Filter”) manufactured by C.R. Bard and Bard Peripheral Vascular Inc.
The IVC Filter was implanted on November 12, 2013 for the purpose of preventing a pulmonary embolism (blood clot in the lungs). Instead, the plaintiff suffered severe injuries as a result of the IVC Filter.
The lawsuit accuses C.R. Bard of strict products liability, manufacturing defect, information defect (failure to warn), design defect, negligent design, negligent manufacturing, breach of implied and express warranty, fraudulent misrepresentation, fraudulent concealment and punitive damages.
The lawsuit was filed on January 30, 2018 in the U.S. District Court for the District of Arizona — Case 2:18-cv-00328-DGC.
It will be centralized with over 3,400 other IVC filter lawsuits that have already been filed against C.R. Bard in a federal Multi-District Litigation in Arizona (MDL No. 2641) — In Re: Bard IVC Filters Products Liability Litigation.
